Terms and license

The licence, in plain words

• Price: $49, paid once. No subscription, no renewal, no activation.
• Who: one individual purchaser, on up to two personal Windows computers that person uses. You may use Fate Tracker with projects you make for yourself or for sale, including commercial games.
• Replacement computer: allowed when you stop using Fate Tracker on the old one.
• How long: no time-based expiry. The version you bought keeps working while you keep to the licence, and it never checks in with a server. Compatibility with future Windows versions, hardware or other tools is not guaranteed.
• Updates: releases during the first 12 months after purchase are included; your purchased version keeps working afterwards.
• System: Windows 11. Windows 10 is not promised until it has been directly tested.
• Honour system: no online activation, tracking, accounts or network calls. A personalised signed offline licence file may be offered in a future release; it would not change the rights you bought.
• Sold through: Gumroad as merchant of record, whose own terms also apply to the purchase.

Warranty, liability and governing law (proposed)

• The software is provided “as is” to the extent the law allows, without a promise of uninterrupted or error-free operation or of recovering every file.
• The provider’s total liability is limited to the amount you paid, except where the law does not allow that limit, including fraud, intentional misconduct, gross negligence, or death or personal injury caused by negligence. Mandatory consumer rights remain available.
• The licence is governed by the laws of the State of New York, United States, while the mandatory protections of your own country or state continue to apply. No compulsory arbitration and no class-action waiver.
• The provider publishes an email address and city and state as its contact details; Gumroad, as merchant of record, publishes its own business details in its terms.

What the software does and does not promise

• Fate Tracker makes verified copies of the project files you ask it to protect, and keeps a record of decisions, instructions and measured changes.
• It certifies file evidence and project boundaries. It does not certify that a game is fun, correct, performant, or secure — those remain matters for your own testing.
• It is a protection workflow to use alongside whole-computer backup, not a replacement for one.
• The software is provided without a warranty that it will fit every purpose or run without fault.

Your responsibilities

• Keep your own independent backups of work that matters to you.
• Keep your safety PIN and Recovery Card private. They will never be requested by the developer, by support, or by any AI assistant. The PIN is separate from this licence: it is a local accident-prevention control, and if both the PIN and the Recovery Card are lost the protected owner controls cannot be reset by anyone, while your game and saved copies remain ordinary readable folders.
• Use the software with projects you have the right to use.

Pre-release test builds

Builds shared with testers before release are not for resale, redistribution, or public posting. They remain the property of the developer and may be withdrawn.
